# Terms of Service for Courtmark

## 1. Acceptance of Terms

By downloading, installing, or using Courtmark ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.

These terms apply to all users of the App, including without limitation users who are browsers, customers, or contributors of content.

## 2. Description of Service

Courtmark is an augmented reality application that assists users in marking sports courts according to international standards. The App provides:

- AR-based court marking guidance with step-by-step instructions

- Support for 11 sports: Basketball, Tennis, Volleyball, Badminton, Pickleball, Futsal, Cricket, Soccer, Padel, Squash, and Beach Volleyball

- World-standard dimensions and markings for all sports

- Progress tracking for court marking projects (stored locally)

The App is provided "as is" and we reserve the right to modify or discontinue the service at any time.

## 3. Purchase and License

Courtmark is available as a paid app through the App Store:

- The App is purchased once through the App Store

- Purchase is processed through Apple's App Store

- Your purchase is tied to your Apple ID and can be restored on any device

- All purchases are final unless required by law

- You must be at least 13 years old to make a purchase

By purchasing the App, you receive a license to use the App on your Apple devices. This license is non-transferable and subject to these Terms.

## 4. Acceptable Use

You agree not to:

- Use the App for any illegal purpose or in violation of any laws

- Attempt to gain unauthorized access to the App or related systems

- Interfere with or disrupt the App or servers

- Use automated systems to access the App without permission

- Reverse engineer, decompile, or disassemble the App

- Remove any copyright or proprietary notices from the App

Violation of these terms may result in immediate termination of your account.

## 5. Intellectual Property

The App and its original content, features, and functionality are owned by Symetronz and are protected by international copyright, trademark, and other intellectual property laws.

- You may not copy, modify, distribute, sell, or lease any part of the App

- You may not reverse engineer or attempt to extract the source code

- All trademarks and logos are the property of their respective owners

You retain ownership of any content you create using the App, but grant us a license to use it for providing the service.

## 6. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

- Implied warranties of merchantability

- Fitness for a particular purpose

- Non-infringement

- Accuracy or reliability of results

We do not warrant that the App will be uninterrupted, secure, or error-free. Court marking accuracy depends on proper device usage and environmental conditions.

## 7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SYMETRONZ SHALL NOT BE LIABLE FOR:

- Any indirect, incidental, special, or consequential damages

- Loss of profits, data, or business opportunities

- Errors or inaccuracies in court markings

- Any damages resulting from use or inability to use the App

Our total liability shall not exceed the amount you paid for the App (if any) or $50, whichever is greater.

## 8. Indemnification

You agree to indemnify and hold harmless Symetronz, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

- Your use of the App

- Your violation of these Terms

- Your violation of any rights of another party

- Any content you submit through the App

## 9. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including:

- Breach of these Terms of Service

- Fraudulent, abusive, or illegal activity

- Request by law enforcement

- Violation of Apple's App Store guidelines

Upon termination, your right to use the App will cease immediately. You may delete the App and all associated data at any time by uninstalling it from your device.

## 10. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of any material changes by:

- Posting the updated terms in the App

- Updating the "Last Updated" date

Your continued use of the App after changes constitutes acceptance of the new terms. If you do not agree, you must stop using the App.

## 11. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the jurisdiction in which Symetronz operates, without regard to its conflict of law provisions.

Any disputes arising from these terms or the App shall be resolved through binding arbitration or in the appropriate courts of jurisdiction.
